ABOUT THE SWEEPSTAKES. Persons primarily enter the KLEENEX® Brand Sneeze Catcher 2.0 Sweepstakes by submitting a photo of their child with at least three (3) of the six (6) elements comprising the Certified Sneeze Catcher Kit. (For the avoidance of doubt, entrant must be the parent or legal guardian of child depicted photo as a Certified Sneeze Catcher.) See below for a description of specific Kit elements as well as how your child can become a Certified Sneeze Catcher. Alternatively, persons can enter the Sweepstakes without their child becoming a Certified Sneeze Catcher; see "Alternate, Non-Certification Entry" below for full details. Administrator will select five (5) prize winners in a random drawing from among all eligible entries received (also discussed below).
HOW TO ENTER: CERTIFIED SNEEZE CATCHER METHOD.
A. Have Your Child Become a Certified Sneeze Catcher.Go to www.atrapaestornudos.com and follow the instructions to get your child certified. (If you have more than one (1) child 13 years or younger who you would like to become a Certified Sneeze Catcher, each child must be certified separately.) A parent's email address will be required for certification of his/her child. After certification is complete, you child will be able to download two (2) Certified Sneeze Catcher Kit elements: your child's Certified Sneeze Catcher identification and an activity book.
NOTE: You/your child CANNOT receive the minimum of three (3) different Certified Sneeze Catcher Kit elements so that you will be able to enter the Sweepstakes via the Certified Sneeze Catcher method solely by getting your child certified online. To receive the minimum of three (3) different Kit elements needed for the Certified Sneeze Catcher method of entry, your child must be certified online AND you must call the 1-800 phone number AND/OR mail in KLEENEX® brand proofs of purchase to receive Certified Sneeze Catcher T-shirts (as discussed below).
B. Call Toll-Free 1-888-718-5569 to Receive for Your Child Additional Elements to Complete Certified Sneeze Catcher Kit. When calling, provide your name, residential address (street address only; no p.o. boxes), phone number, first name and age of your child (additional elements are available for one child per call), as well as answering the questions regarding facial tissue. (Questions need not be answered correctly.) Approximately 4 – 6 weeks after registration, you will receive, by postal mail, these additional Kit elements for your child: activity booklet (different from activity booklet available via Step A), KLEENEX® branded bag, manufacturer's coupon redeemable for KLEENEX® brand facial tissue, and product sample of KLEENEX® brand facial tissue. While supplies last. The 1-800 number will be operational Monday – Friday, 9 a.m. ET – 5 p.m. ET, beginning January 30, 2012.
Or, Mail in KLEENEX® Brand Proofs of Purchase for a Certified Sneeze Catcher T-shirts. Place in a business size (#10) envelope the following materials: (1) your original store-identified receipt with purchase of 3 KLEENEX® brand facial tissue packages circled; (2) the original bar codes from the purchased KLEENEX® brand tissue products; (3) your name, residential address (street address only; no p.o. boxes), phone number, first name and age of your child, on a 3" x 5" paper and mail to KLEENEX Certified Sneeze Catcher Sweepstakes Entry, 8250 NW 27th Street, #301, Miami, FL 33122. Approximately 4 – 6 weeks after submission, you will receive, by postal mail, one (1) child-size Certified Sneeze Catcher T-shirt (to be used as part of your child's Kit) and one (1) adult-size Certified Sneeze Catcher T-shirt (as an additional gift for you which is not to be used as part of the Kit). See below for important additional restrictions on the Proof of Purchase Offer.
To assure ample time to receive the minimum of (3) different Kit elements and enter the Sweepstakes via the Certified Sneeze Catcher method, one must get their child certified online and obtain the additional elements of the Certified Sneeze Catcher Kit by calling the 1-800 phone number or mailing in KLEENEX® brand proofs of purchase by 5 p.m. ET, 3/10/12. (For the avoidance of doubt, mail (proofs of purchase) submissions must be received by 5 p.m. ET, 3/10/12.) Receipt of materials after the indicated time may not result in receipt of the minimum of three (3) different Kit elements with enough time in order to enter Sweepstakes via the Certified Sneeze Catcher method.
But, if you live in (or are visiting) Miami, Florida, Los Angeles, California, Houston, Texas or San Antonio, Texas, your child can also become a Certified Sneeze Catcher and receive the minimum of three (3) different Kit elements at special events in February and March 2012. See the event schedule at www.atrapaestornudos.com for exact dates and locations of Certified Sneeze Catcher events. Those registering their child at an event will receive, at the time of registration: Certified Sneeze Catcher identification, activity booklet (same as available via Step A), KLEENEX®-branded silly bands, manufacturer's coupon redeemable for KLEENEX® brand facial tissue, and product sample of KLEENEX® brand facial tissue. In addition, if you present an original store-identified receipt with purchase of [QUANTITY/SIZE] KLEENEX® brand tissues circled and the original bar codes from the purchased KLEENEX® brand tissue products, you will receive one (1) adult-size Certified Sneeze Catcher T-shirt and one (1) child-size Certified Sneeze Catcher T-shirt.
C. 3rd, Take a Photo of Your Child with at least Three (3) Different Kit Elements. Print your full name, complete address and daytime telephone number on a 3"x 5" paper and mail with your original photo of your child (print in ink child's first name and age on back of photo) to: KLEENEX Certified Sneeze Catcher Sweepstakes Entry, 8250 NW 27th Street, #301, Miami, FL 33122, to be received by 4/30/12. Your 3"x5" paper and photo with all required information together constitute your entry in the random drawing. Or, you may submit your child's photo via email at kleenexphoto@massinc.com. Include required information with email submission, which includes: full name, complete address, daytime phone number as well as child's first name and age. Photo must be submitted as an email attachment. Your email with the attachment with all required information constitutes your entry in the random drawing. (Please submit entry either by mail or email but NOT via both methods.)
Limit one (1) entry per person regardless of number of his/her children who are Certified Sneeze Catchers.
RESTRICTIONS ON PHOTO. Photo must be in color. If submitted by mail, photo can be no larger than 8" x 10"; if submitted by email, photo must be in one (1) of the following file formats: [ACCEPTABLE FORMAT A, ACCEPTABLE FORMAT B, ETC.] DO NOT COPY OTHERS' WORK.
Photo must include at least three (3) different elements of the Certified Sneeze Catcher Kit, but any Kit elements may be used; if photo does not contain at least three (3) different Kit elements, entry containing such photo will be declared void and disqualified.
If Sponsor determines, in its sole discretion, that Kit element(s) are not valid such that photo does not meet minimum requirement of any three (3) different Kit elements, entry will be declared void and disqualified.
Photo must include only entrant's child and entrant him/herself: Do NOT include any other persons in the photo.
If others' property is identified in photo, be sure to obtain the written permission of the owners of such property (if another person took photo, you must get his/her written consent prior to submitting the photo as a Sweepstakes entry). Entry containing photo will be declared void and disqualified (a) if photo is inappropriate, profane or unfit for publication as determined by Sponsor in its sole discretion (e.g., photo includes obscene gestures); (b) if Sponsor, in its sole discretion, suspects that the photo includes any content that is not owned solely by entrant (or that entrant does not have a license, permission or other legal right to use) such that usage of the content violates the rights of trademark, copyright or any other right of any third party, as determined by Sponsor in its sole discretion; (c) if the photo promotes a commercial/business enterprise, a charity, political, religious cause or any cause other than the Sweepstakes theme; (d) if the photo has been previously published online or elsewhere.
Restrictions on Certified Sneeze Catcher T-shirt Proofs Of Purchase Offer. T-shirts are available while supplies last. Limit one (1) submission (and one (1) adult-size T-shirt and one (1) child-size T-shirt) per person/household/address. For the avoidance of doubt, persons can either make Proofs of Purchase Offer submission by mail or at a Certified Sneeze Catcher event, but not both ways. Even if person has more than one (1) child registered as a Certified Sneeze Catcher, he/she may only obtain a maximum of one (1) adult-size T-shirt and one (1) child-size T-shirt in Proofs of Purchase Offer. To participate in Offer, purchase of KLEENEX® brand tissues must have been made no earlier than 1/23/12. Store-identified receipts and KLEENEX® brand product bar codes are void and will not be accepted if reproduced, purchased, auctioned, transferred or sold. Proofs of Purchase Offer is not valid with any other KLEENEX® brand or Kimberly-Clark coupon, offer or promotion. Any use of store-identified receipts and KLEENEX® brand product bar codes other than as set forth in these Official Rules is not valid for this Sweepstakes and may constitute fraud. Proofs of Purchase Offer is not redeemable in-store.
ALTERNATE, NON-CERTIFICATION METHOD OF ENTRY. To enter WITHOUT your child becoming a Certified Sneeze Catcher, print your full name, complete address, daytime telephone number, your child's first name and age, and Non-Certification Entry on a 3" x 5" paper and mail to KLEENEX Certified Sneeze Catcher Sweepstakes Entry, 8250 NW 27th Street, #301, Miami, FL, 33122, to be received by 4/30/12. Limit one (1) alternate, non-certification method entry per person. (For the avoidance of doubt, alternate, non-certification method entries will ONLY be accepted by mail, not via email.)
SELECTION OF WINNERS/RANDOM DRAWING. The Winners will be selected in a random drawing from among all eligible entries received by the entry deadline of 4/30/12. The drawing will be conducted by Administrator, Sponsor's independent judging agency, and will take place on or about 5/15/12. The content/quality of the photo included as part of one's entry (for those who enter via the Certified Sneeze Catcher entry method) or, whether one chooses to include a photo at all, will have no affect on the selection of winners.
All entries become the property of the Sponsor and will not be returned. (If entering via the Certified Sneeze Catcher entry method, you may wish to make a copy of your photo before submitting it as a Sweepstakes entry.) For their entry to be eligible for drawing, those who enter via Certified Sneeze Catcher entry method (on behalf of themselves and their child) hereby irrevocably assign and transfer all rights, title and interest in their entry submission (i.e., their photo), including but not limited to all copyrights, patent rights and all other proprietary rights therein, to the Sponsor. Such entrants (on behalf of themselves and their child) further agree to complete and sign any additional written authorization, assignment or other papers requested by the Sponsor in connection with the transfer and assignment of rights to their entry submission, without compensation. Sponsor may use, edit and publish in whole or in part any and all such entry submissions in any media whatsoever, without time or geographical restrictions, without providing any compensation or consideration to entrants or notifying entrants as to such activities; and, entry submission may or may not be attributed to entrant, in Sponsor's sole discretion. Nothing herein, however, obligates Sponsor in any way to use entrants' photos and such non-use will not result in any liability to Sponsor of any kind.
GRAND PRIZES AND ODDS OF WINNING: Five (5) Grand Prizes are available to be won in the Sweepstakes. Each Grand Prize is twelve (12) months' worth of KLEENEX® brand facial tissue (awarded as manufacturer's coupons good for forty (40) boxes of KLEENEX® brand facial tissue [any size]; coupons are subject to terms/conditions indicated thereon) and a $500 VISA** gift card. Approx. Retail Value: $780 each. Odds of winning depend on the number of eligible entries received.
PRIZE RESTRICTIONS: All unspecified costs and expenses in conjunction with acceptance/receipt/use of prize are the winner's sole responsibility. No prize substitution or cash equivalent except at Sponsor's sole discretion for prize/prize component of equal value. Prize is not redeemable/exchangeable by winner for cash (except as required by law). No prize transfer. Federal, state and local taxes are the sole responsibility of the winner; winner's receipt of prize will be reported to the Internal Revenue Service via IRS 1099 Tax Form.
ELIGIBILITY: Open to legal U.S. residents, age 18 years or older with at least one child 13 years or younger, as of Sweepstakes start date. Employees of Kimberly-Clark Global Sales, LLC, its affiliates, distributors or advertising and promotional agencies (including Administrator) and members of their same household or immediate families (spouses, children, parents, siblings and grandparents) are not eligible. WINNER NOTIFICATION/RELEASES: The potential winners will be notified by telephone or postal mail or e-mail. Potential winners will be required to sign and return an affidavit of eligibility, liability release and a publicity release (where lawful) within seven (7) days of receipt. If an individual cannot be contacted, is ineligible or fails to timely return a completed and fully executed affidavit of eligibility/release as required, the prize will be forfeited and an alternate winner will be selected from among all remaining eligible entries received. Entry and acceptance of prize constitutes winner's permission to use winner's name and likeness (and/or the name and likeness of winner's child) for publicity/advertising/trade purposes without approval or further compensation where not prohibited by law.
GENERAL CONDITIONS: By entering, participants agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator, which shall be final and binding in all matters pertaining to the Sweepstakes. Kimberly-Clark Global Sales, LLC and its subsidiaries, affiliates, distributors, agencies, officers, directors, agents, advertising and promotional agencies (including Administrator), and their respective employees, officers and directors are not responsible for and shall not be liable for: (1) illegible, incomplete, damaged, delayed, misdirected, late, lost entries/submissions, postage due mail or delays or defects in delivery of elements of Certified Sneeze Catcher Kit (including Kit elements and/or certification of child as a Certified Sneeze Catcher) to persons requesting same (regardless of cause); (2) stolen entries/submissions; (3) telephonic error, electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind including any injury or damage to entrant's or any other person's computer related to or resulting from participating or uploading or downloading any materials in conjunction with participation in the Sweepstakes; (4) errors or delays in transmission either by phone (including, with regard to the 1-800 number, disconnected, corrupted or dropped phone calls and incomplete or incorrect transcription of callers' information) or online (including garbled, jumbled, corrupted, inaccessible or otherwise illegible online transmissions, or inability to upload or download materials in conjunction with participation in the Sweepstakes); (5) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (6) any losses or damages of any kind caused by the prize or resulting from the acceptance, possession or use or misuse of the prize, or from participating in the Sweepstakes, (7) or any printing or typographical errors in any materials associated with the Sweepstakes. And, in such case, disqualification shall not represent the sole remedy available to Sponsor. Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of such provision. Notice of such action by Sponsor will be posted on www.atrapaestornudos.com.
DISPUTES/CHOICE OF LAW. The Sweepstakes (including activities in conjunction with participation in the Sweepstakes) shall be governed by and interpreted under the law of Wisconsin (except for choice of law/conflict of law principles that would result in the application of the law of any state other than Wisconsin). Any legal action regarding the Sweepstakes must be brought individually (NOT as part of a class action) in the federal or state courts of Winnebago County, Wisconsin and, by participating, entrants agree to the personal jurisdiction of such courts. Entrants further agree that their recovery in any such legal action shall be limited to their actual out-of-pocket costs to participate in the Sweepstakes (if any), with all other damages or remedies being expressly waived.
LANGUAGE DISCREPANCY. Should there be any inconsistency or discrepancy between the English language and the Spanish language versions of these Official Rules, the English language version shall prevail, govern and control.
